A direct mailing headed "IMPORTANT NOTICE REQUIRING URGENT ATTENTION" promoted a warranty service for Sky satellite systems.

The complainant challenged how the advertisers had obtained her contact details.

Assessment
Upheld
The ASA noted Digital Satellite Warranty Cover had removed the complainant's details from their database. However, we noted that under the CAP Codes they were required to tell us how they had obtained those contact details. Because they did not do so, we considered the ad was in breach of the Code.
The ad breached CAP Code clause 43.13 (Database practice).
Action
The ad must not appear again in its current form.
